ikenga.me herein referred to as “the website”, “we” or “our” is fully owned and managed by IKENGA TOURS, a travel service firm registered in the city of Essen, Germany under the tax ID number DE 68937045133. Our registered office.​

By using the website or placing orders, you confirm to be bound to these Terms and Conditions “the terms”. We can at our discretion modify the terms listed on the website. Our new terms will be made available on the website and by continuing to access and utilize the website, you agree to comply with the terms.​

Any goods or services that you purchase on the website will be subject to our Terms for Online Orders and will thus apply accordingly.

Our terms and entire website policy are available in English and German only.

In no way will any of our terms affect your statutory rights.

Nothing in these terms and conditions grants you any legal rights in the website other than as required to grant you access to the website. You agree not to modify, avoid or remove any notices, including intellectual property notices contained on the website. In addition, any digital rights, security embedded technology or similar features contained in the website.

We do not control over third-party websites and thus, bear no responsibility for any content, material or information contained in them. TERMS FOR ONLINE ORDERS

ELIGIBILITY TO ORDER

In order to shop on the website you must be 18 years old or over and;​

  • ​Provide us with your real name (as it appears on your valid  ID-card/passport) contact information and payment when creating an order.
  • Provide us with a delivery address.
  • Possess a valid payment method that works on the website.
  • Be able to present your valid ID-card on delivery of your items.

ORDER ACCEPTANCE

All orders made on the website are subject to confirmation in conformity with the following terms;

  • You will be allowed to confirm the details of your order, together with your address and payment details, before completing your purchase.
  • Once your purchase is made, an acknowledgement email will be sent to you by us, informing you of our receipt of your order. Kindly note that this is neither an order acceptance nor confirmation of your order.
  • We will communicate to you via email or in a few instances via telephone to inform you that your order is en-route. This is confirmation that your order has been accepted.
  • Unless otherwise stated, your order will be delivered within 4 business days of your order. Where we are unable to fulfill your order within this period, we reserve the right to cancel your order.
  • Your order will be executed once the ‘Pay Now’ button is clicked. You hence, permit us to proceed with your order as requested.

We may be unable, or refuse, to accept your order in the unlikely event that;

  • One or more items in your order are unavailable.
  • We are unable to process the payment for your order, or your payment method has been refused.
  • We recognize a pricing or product description error.
  • Your product fails to meet the requirements of local import restrictions or requirements at your delivery destination.
  • You fail to meet order eligibility criteria or fail to act in accordance with our terms.

If for any reason we are unable to accept or process your order we will contact you as soon as possible.

​PRICES, PAYMENTS AND CHARGES
  • At IKENGA TOURS we take utmost care to ensure that products are priced accurately on the website, notwithstanding pricing errors might occur. If we have made an error in the price of a purchase you made, we will contact you as soon as possible. You will have the option to either reconfirm your order at the correct price or revoke it.
  • Prices of products on the website can change. Offers and promotions may be withdrawn at any time.     ​
  • You may incur additional charges or import duties, these levies depend on your delivery address and the tax laws that apply in that country. For shipments made outside the European Union, we will inform you at the Checkout process if additional charges will apply or if you have to pay for them separately. Should they not be part of the total price, we can neither influence nor advise you on the amount which you must pay to the customs authority of the delivery destination. You will be solely responsible for paying all import duties and taxes that are not included. We therefore, state that you contact the customs department of the delivery address for advice and guidance of import duties before placing your order.
  • If you are accessing the website from Germany, the product prices advertised are inclusive of German VAT. Delivery costs are not included in the prices and will be added at the Checkout.
  • All credit and debit cards are subject to authorization and validation checks by your card issuer. If the issuer of your payment card refuses to or does not for any reason, authorize payment, we cannot be held responsible for any delay or non-delivery.
  • Should you choose to cancel or return products purchased during a promotion or at a discounted price, you will be refunded for the goods at the price charged at the Checkout. Kindly note that you are still subject to our Refunds & Cancellations policy when returning products purchased in a promotion or at a discounted price.  

PRODUCT DESCRIPTIONS, INGREDIENTS AND RESTRICTIONS
  • We do not guarantee that the images of products viewed on the website are an accurate depiction; occasionally, colors may differ from the images seen on the website, which may be as a result of your electronic device screen resolution or configuration. 
  • All products seen on the website are subject to availability at the point of sale. Once a product is sold out, it will not be temporarily taken off the website and may be purchased again until further notice. Should an order made by are out of stock, we will contact you as soon as possible to either amend the order or cancel the order in whole or in part.    ​
  • We cannot be held  liable for any allergic reactions in relation to the use or consumption of products. For detailed information about ingredients and allergies in any of our products, kindly look at the particular product page or contact us immediately.
  • We reiterate that you must be aged 18 or over to purchase any product on the website.

DELIVERY OPTIONS

DELIVERY CARRIERS AND TIME

Unless using IKENGA EXPRESS, of which delivery addresses fall within the vicinity of the Rhein-Ruhr region of Germany, all other deliveries will be fulfilled by third-party couriers. By placing an order on the website, you agree to the conditions of carriage of our delivery partners.

The estimated delivery date of the products will be stated in your order confirmation email. If an estimated delivery date is not issued by us,we will deliver your order within 4 days from the date of dispatch. We will do our best to ensure that your order is delivered by the estimated delivery date; however, there may be instances where deliveries are delayed by no fault of our own, such instances are but not limited to; force majeure, war, riots,extreme weather, energy shortages, national/regional strikes, government-imposed lock-downs, curfews and public holidays. Nonetheless, we will do everything within our power to ensure that your order is delivered within reasonable time; notwithstanding, we will not be held liable for any losses whatsoever as a result of such delay.

Our delivery partners might occasionally offer alternate delivery options, which may include; signature release and/or leave with a neighbor. By selecting or issuing such instructions to receive your order through one of these options, you acknowledge and agree that we are not liable for any losses or damages that may occur from this service. 

PROOF OF IDENTIFICATION​

Certain deliveries require you to produce a valid ID for physical authentication and age confirmation.

EXCISE DUTIES, TAXES AND TARIFFS

You are obliged to take note of import duties, levies, tariffs and taxes imposed by every country. If your delivery address is outside the European Union, you will be liable to pay any additional costs that arise at the port of entry of the country of the delivery address. You will be notified at the Checkout process, if import duties are included in the total price. We at IKENGA TOURS neither influence nor set these charges, we therefore, cannot counsel nor estimate what additional charges you may incur in import duties and taxes. It is your responsibility to contact the customs department of the country of your delivery address and seek further advice on excise duties. We at IKENGA TOURS are not responsible for your order being delayed or confiscated at the port of entry.

Additional information or certification may be requested in certain countries for your order to be fulfilled, failure to obtain these certificates may delay your order being delivered. After we exhaust every means to procure the relevant certification, we will ultimately have to cancel your order.

OUR LIABILITY

We are responsible to you for expected loss and damage to you by fault of our own. Should we fail to fulfill these terms, we are responsible for loss or damage you suffer as a direct consequence of our failure to fulfill these terms. Damage is expected if it is apparent that it will occur, at the time the contract was entered into, both we and you had knowledge it might occur, beforehand.

We do not limit or reject our liability to you where it would contravene with the law. This includes liability for personal injury or death caused by negligence either by us, our agents or subcontractors; for fraudulent misrepresentation; and for violating your statutory rights in connection to the products found on our platform.

We are not liable for business losses. Should you use these products for resale or any commercial business purpose, we will have no liability to you for any loss or damage, in profit, business interruption, or business opportunity.
